Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Isocast website, API, and weather-signal data (together, the “Service”), operated by Isocast (“Isocast,” “we,” “us”). Please read them carefully. If you do not agree, do not use the Service.

1Parties & Acceptance

By accessing the Service — including by having software you deploy send a request to the API — you agree to these Terms. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” means that entity.

Electronic agents.The Service is designed to be used by autonomous software agents. Under the electronic-agent principles of UETA and the U.S. E-SIGN Act (and equivalent law elsewhere), a contract may be formed by the action of an automated agent without human review of each transaction. Deploying, configuring, or funding an agent to interact with the Service constitutes your acceptance of these Terms, and any request that agent makes — and any payment it authorizes — binds you as the human or entity principal. We log the version of these Terms in force at the time of each paid transaction against the paying wallet. You are responsible for your agent’s conduct, including misinterpretation, hallucination, or budget overruns; we are not liable for your agent’s decisions.

2Service Description

Isocast is an informational data service. We monitor the observed daily-high temperature for a set of cities and, when a city’s reading crosses into a new temperature bucket used by a public prediction market, we emit a structured, descriptive signal recording that event and the market’s then-current odds.

We sell information only. We do not place bets, custody or hold funds for wagering, execute trades, operate or control any market, or act as a broker, dealer, exchange, investment adviser, commodity-trading adviser, or financial adviser. Signals are descriptive records of a physical observation — never a recommendation to buy, sell, wager, or trade. See also our Disclaimer.

3Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service you represent that you are not a sanctioned person, that you are not located in an embargoed or restricted jurisdiction, and that accessing prediction-market data — and acting on it — is legally permitted for you where you are.

4Payment Terms

Live signal delivery is paid. Payment is made in USDC on the Base network using the x402 protocol. Signals are sold in prepaid per-city bundles; the minimum spend is 0.01 USDC and the per-signal price decreases with bundle size (from 0.005 down to 0.0035 USDC per signal). One settlement credits a signal balance that is drawn down as signals are delivered.

All prices are exclusive of taxes. You are responsible for any sales, use, VAT, or similar taxes, and for any tax reporting arising from your use of the Service. Blockchain network fees are your responsibility.

5Refund Policy

Refunds are issued only through our automated x402 refund queue, which returns funds when a payment settles but the corresponding signal entitlement is not delivered (a charge-but-no-deliver failure). Outside of that automated failure path, all sales are final and prepaid signals are non-refundable. Unused prepaid signals do not expire.

6Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose, or where prediction-market activity is prohibited for you;
  • resell, redistribute, sublicense, syndicate, or publicly republish the signals, or make them available to any third party as a data product;
  • cache or store signals beyond a reasonable internal window of 24 hours, except as needed for your own internal operation and audit;
  • circumvent, disable, or exceed rate limits, entitlement checks, or payment binding;
  • scrape, poll, or extract data beyond the tier and volume you have paid for;
  • use the Service to build a competing signal or data-redistribution product.

7Rate Limits

Free discovery, pricing, and sample endpoints are subject to reasonable rate limits. Paid signal access is metered by your prepaid balance. We may throttle, suspend, or block traffic that we reasonably believe is abusive, automated beyond your entitlement, or degrades the Service for others.

8Intellectual Property

The Service, the signal data, and all compilations, selections, and arrangements of that data are owned by Isocast and protected by intellectual-property law. Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the signals you purchase for your own internal purposes only. All rights not expressly granted are reserved.

9AS-IS / No Warranty

The Service and all signals are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory, including any warranty of merchantability, fitness for a particular purpose, accuracy, timeliness, or non-infringement. Signals may be delayed, inaccurate, incomplete, or stale. We make no guarantee that use of the Service will be profitable or produce any particular result. You rely on the Service at your own risk.

10Limitation of Liability

To the maximum extent permitted by law, Isocast will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or trading or betting losses, arising out of or relating to the Service, even if advised of the possibility. Our total aggregate liability for all claims relating to the Service is capped at the total fees you paid to Isocast in the 30 days preceding the event giving rise to the claim.

11Assumption of Risk

You understand that prediction-market trading and any decisions informed by the signals involve substantial risk, including the risk of total loss. You are solely responsible for your own decisions and for evaluating the accuracy and suitability of the signals for your purposes. You assume all risk arising from any use of the Service.

12Service Availability

We do not guarantee any uptime, latency, or continuity of the Service and provide no service level agreement (SLA) unless separately agreed in writing. The Service may be interrupted, suspended, or discontinued at any time, including for maintenance, third-party outages, or circumstances beyond our control.

13Indemnification

You agree to indemnify, defend, and hold harmless Isocast and its operator from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of applicable law, or the conduct of any agent you deploy.

14OFAC / Sanctions Representation

You represent and warrant that you are not, and are not owned or controlled by, a person named on the U.S. Treasury OFAC Specially Designated Nationals (SDN) list or any applicable sanctions list, and that you are not located in, or ordinarily resident in, a comprehensively sanctioned or embargoed jurisdiction. We screen payer wallet addresses against the OFAC SDN list and may block, reject, or reverse payments from, and terminate access for, any wallet or person we reasonably believe to be sanctioned.

15Prediction Markets — No Gambling Operator

Isocast sells information about publicly available prediction markets. We do not operate, control, or partner with any prediction market, sportsbook, or gambling operator; we do not accept or place bets; and we do not custody funds for wagering. Prediction markets such as Polymarket are restricted or unavailable to persons in certain jurisdictions (including, historically, U.S. persons) and to persons under the applicable minimum age. It is your responsibility to determine whether accessing prediction markets — and acting on our information — is legal for you.

16Governing Law & Disputes

These Terms are governed by the laws of the operator’s country of establishment (Poland) and applicable European Union law, without regard to conflict-of-laws rules. Any dispute arising out of or relating to the Service or these Terms shall be subject to the jurisdiction of the competent courts of that country, except where mandatory consumer- protection law grants you rights in your place of residence.

17Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18Changes to Terms

We may update these Terms from time to time. When we do, we will revise the version and effective date above and publish the updated Terms at https://isocast.dev/terms (machine-readable at /terms.txt and /terms.json on the API). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
